Amercement - Fine paid in a Manorial Court
Barreyfyt - Any ideas ?
Carr - Term for marshy land.
Codde - Possibly to bag.
Balke - Strip of ground left unploughed as a boundary between
two ploughed portions
Byrlawemen - Constable responsible for the by-laws of a manor.
Butt/butte - Strips of land abutting on a boundary
Coppe - Probably a type of sluice gate or banking.
Close - An enclosure from the open fields.
Demynges - Dam to stop up water.
Fetters - Shackles for animals.
Flatt/flatte - Pieces of level ground or strip at right angles
to other strips.
Hey - Small enclosed field.
Hoole - Hole ?
Lache - Pond.
Marl - Decayed clay soil used as fertilizer, pits to obtain marl
were usually 30-50 feet across.
Merestone - A stake or stone used for marking a boundary.
Mossreve - Baliff who recieved and dealt with claims for land
on swamps and mossy areas.
Pinder - A manor or parish officer in charge of the pound or pinfold.
Pinfold - Enclosure for stray animals.
Platte - Bridge over a ditch or dyke made of earth and stones.
Reate/Rait - Process used in the treatment of flax and hemp, by
laying it in a pond or ditch for a prolonged period of time to
water or reason it, offenders were often fined by the courts on
account of the obnoxious smell.
Reyne - Ditch or culvert.
Relict - Widow.
Rood - A measure of 40 sq Rods, an acre consisted of 4 Roods.
Spowte - Possibly a drainage hole.
Scour - To clear or clean out ditches or watercourses.
Swyngle (hand) - Wooden implement resembling a sword for beating
and scraping hemp and flax to remove loose particles (danger of
fire in candlelight.)
Tinsel/tincel - Brushwood for fencing
Wayne - Large open four wheeled waggon used on farms (haywain)
Yate - Gate (Lydyate possibly Coe Lane.)

Rigbye belonged to the Rygbe family of Harrock Hall at Bispham
who were staunch Catholics, A later Colonel Alexander Rygbye was
MP for Wigan, also a noted officer for Parliament in the Civil
War.

the same place before Alexander Rigbye, Esquire Steward of the
said Thomas and Henry in the same place, on Friday that is to
say the 25th of October in the nineteenth year of our Lady Elisabeth,
by the grace of God, of England, France and Ireland, Queen, defender
of the faith etc.
Inquiry taken
in the same place by the corporal oath of Richard Banester, Gentleman,
William Sutton, Henry Wallbanke, Nicholas Tailear, Thurstan Wignall,
James Dandie junior, James Dandie senior, Robert Johnsone, Hugh
Richardson, alias Thomasone, George Norres, Thomas Wignall, Hugh
Abraham, William Dobson, Lawrence Caunse, Henry Fazakerley and
Richard Abraham, jurors.
Who say and
present upon their corporal oath that Edward Crosse made an assault
and affray upon, Ralph Catterall, and drew blood from him, therefore
he is fined 6s 8d. And it is ordered that if the aforesaid Edward
should not come to pay the fine within one year now next following,
then the Constables in the same place should pay the aforesaid
fine for their negligence in permitting him to escape without
sureties. 6s 8d
And that Matthew
Todde made an assault, called " a Tustle" (ie a tussle),
on and upon John Calle, therefore he is fined 12d. And it is ordered
that if the aforesaid Matthew should not come to pay the aforesaid
fine within one year now next following, then the Constables in
the same place should pay the aforesaid fine for their negligence
in permitting him to escape without sureties. 12d

the caste parte and Willm Dandye the younger and the Late wyfe

of the meydoo Buttes as the Jury have allredy apoynted and meyred

in places where the Jury sworne at this Courte have apoynted the
meyres to be Betwexte the meadowe butte in the occupacion of John
Call and the saide Rydecarre meydowe within one fortenight nexte
after the XVIth day of November nexte upon payne of every one

before the XVIth day of November next Betwene the Landes in the
occupacion of the saide Richard called the Kybles and the meydowe
landes in the occupacion of the saide Willm in plattes where the
saide Jury bath appoynted meyres to be upon payne of eyther of
them makinge defaute 12d

the Jury find that Willm Jenkynson Alias Myles haithe dyched to
farre upon the said Richard Banester at the kybles and that Robert
Norres bath dyched to farre there upon John dandy that they ordered
that the said Willm Jenkinson Alias myles and Robert Norres shall
not dyche hereafter any further then to the meyres nowe set by
the said Jury upon payne to forefeyte such as shall dyche further

towne as shall or doo occupye any arable Lands or Meydowe Betwene
the plockes and the Southe syde of the lytle meydowe to passe
and repasse with carte and wayne for theyre necessarye caryage

plockes by and alongest all the said meydowes in such place and
places as was used before tyme unto the said Southe syde of the
saide Lytle Meydowe at all and every tymes and tyme of the yere

at his pleasure

yere uppe one Butte another yere uppe another Butte in the longe
hall doore till he come to the hedde land and soo to the gate

or dyche within this towne without lycence of the owners or makers
thereof nor in anye place adioyninge to the highe waye upon payne

the advyse or apoyntment of the Byrlawmen or twoe of them at the
leaste in Suche Sorte as neyther Geese nor dygges shall Come Swyme
or Clymbe uppe in or thorowe the same or by Reason thereof in
to the Fyldes or Closses of other Tenantes within the said towne
upon payne of every person offendynge herein and being apoynted
by the Byrlawemen for every tyme 3d

all such as have any heyes or Closses at the west mosse which
doo reache unto the west mosse with West Ende shall Stoppe up

the Landes lyenge upon the northe syde of the Blacket From the
Lane that goeth up into the mosse Betwene Norres hey and Robert
Johnson hey unto the Blackette all the mosse above abutting upon
the same shall have that water course at the northe ende thereof
betwixt eyght acres frome the same lane to the utter side syde
of a closse in the occupacion of the late wyfe of Thurstan Whyttell
and there a demmynge to be made shall have that course downe the
dyche Betwene Richard Todde and James Dandy the yonger And all
the Landes and mosse Abutting upon the Rest of the said Landes
to the Blacket shall have that water course downe the dyke of
John dandy and so All the Landes frome the East syde of A closse
in the occupacion of James Hunter Hughe Tomes and Thurstan Wygnall
upon the Southe syde of the same lane and the mosse Abuttynge
upon the same unto the Blackette shall have that course eyther
at the southe endes of the said Closses or else thorowe some of
the dyches as maybe beste caries the water frome the saide mosse
by the discrecion of the Byrlawemen as that upon the northe Syde
of the Said Layne

esquire, Steward of the Lords Thomas and Henry of the Court aforesaid,
on the twenty sixth day of October in the nineteenth year of the
reign of our Lady Elizabeth, by the grace of God, Queen of England,
France and Ireland, defender of the faith etc.
Inquisition
Taken in the same place by the oath of Robert Hesketh,
gentleman, William Jompe, Oliver Breakell, Henry Hodges, Edmund
Wignall, Richard Howicke, Edward Wildinge, Adam Banester, Robert
Cawdrey, Richard Philipson, John Banester, Richard Banester,
Robert Becansall and Richard Loxome, Jurors,
Who say upon
their oath that William Letherbaroo and Elizabeth his
wife owe Suit of the aforesaid Court and have not appeared at
the same,
therefore they are amerced . 12d
And that Edward Wyldinge made assault and affray upon John Gyrdler,
and drew blood from him, therefore he is fined 6s 8d
And that the aforesaid John Gyrdler made assault and affray upon
the
aforesaid Edward Wyldinge and drew blood from him, therefore he
is
lined 6s 8d
And that Richard Cawthrey cut down the wood of Robert Hesketh,
gentleman, therefore he is amerced 4d
And that Thomas Wignall made a trespass in the leasowes in the
lands
of other people, therefore he is amerced 6d
And that the wife of Thomas Howicke cut down the grass and hay
of
other people, therefore she is amerced 6d
And that all these whose names are underwritten have made trespasses
with their cattle and draught animals in the fields in the same
place,
therefore each of them is amerced as appears separately, as may
appear
separately by their name, that is to say, Robert Hesketh gentleman
(12d),
Richard Jompe (12d), Richard Banester (12d), Richard Philipson
(12d),
Edmund Wignall (12d), the wife of Thomas Howicke (12d), Adam

And that John Thorneton made a trespass against Oliver Breckill

without the notice or permission of the Moss Reeves, therefore

gutters within the said townes yerely from henceforth before the
last day of Aprill upon payne of every one not soo makinge the
same to forefyte for every daye after the said laste daye of Aprill
yerely that they shall be unmade 4d
ITEM that noone shall tune Cattell loose into the towne fielde
betweene Thanunciacon of oure "dye and the gettinge in of
the laste Come in the said felde upon payne for every tyme 12d
ITEM that the inhabitantes of Hesketh and Beccansall shall make
theire folde yerely before or upon the VI1th daye Aprill upon
paine to forefyte for every daye that the same shall be unmade
after the said V11th daye of Aprill 12d
ITEM that the said inhabitants shall make theire fences hedges
and dyches Betwene the waste and theire severall grounde yerely
before the Feaste of thanunciacon of our Ladye upon payne to forefyte
every one that shall not yerely make his parte thereof before
the sayde feaste for every daye that the same shall be unmade
after that feaste 12d
PROMIDET allwaies that such Ground as lyeth within the flonde
Markes shall be made at the Apointment and by dyscrecon of the
Byrelawemen
